Background
This is a case where daughters claim equal share in the property of their late father. After the death of the father petitioner’s 03 brothers got property mutated in their name in the Revenue Record. Petitioner and her 02 other sister filed Mutation Appeal before Sub Collector, Sundargarh. Sub-Collector directed Tehsildar to record the name of 03 sisters in the Record of Rights (RoR). Name was recorded in RoR along with their 03 brothers. Daughter’s than claimed equal share in the property before Claim Commission being daughter of the Coparcener are entitled to get equal share as that of her brothers irrespective of the date of death of her father. Brothers disputed on the basis of the Judgment of the Supreme Court namely Prakash and others v. Phulabati and others & Mangammal @ Thulasi and another v. T.B. Raju and others. In these cases, it was held by the SC that daughters are not entitled to get the benefit being not the co-sharer. Claim Commission decided the matter against the petitioner on 04.01.2020.
Contention of the Petitioner
Judgment, basing upon which the Claims Commission decided the matter, had been referred to the Larger Bench and the Larger Bench decided the same in the case of Vineeta Sharma v. Rakesh Sharma and others, 2020 (II) OLR (SC) 569, which was in favor of the petitioner.
Being daughter of the Late Kulamani Patel stand on the same footing as are the sons.
In view of the decision of the larger Bench in the case of Vineeta Sharma v. Rakesh Sharma and others, the decision of the Claim Commission is not sustainable and it be quashed.
Contention of the Respondent’s
Since the parties (Petitioner Daughter) approached the Claims Commission for adjudication of the matter and the same was decided on the basis of the law applicable at the relevant point of time. Wherefore, the present Writ Petition be dismissed.
 Writ Court exercising a limited supervisory jurisdiction constitutionally vested under Article 227 should abhor to undertake a deeper examination in such matters.
Hindu Law & Amendment in Hindu Law (2005)
In Hindu Law Succession of property in a Hindu Undivided Family is governed by two schools of law 1. Mitakshara 2. Dayabhaga. Mitakshara entitles a son to a right equal to his father in the joint family property by birth.
All the male descendants of a Hindu in the male line up to the fourth degree of generation are his sons. The adopted child also gets a right equal to the right of his adoptive father in the joint family property from the date of adoption. The daughter is not given a right by birth in the joint family property.
The Parliament, being inspired by the amendments in four States namely Andhra Pradesh, Tamil Nadu, Maharashtra & Karnataka, passed The Hindu Succession (Amendment) Act, 2005 for the whole of India.
The amendment is that even in a joint family governed by the Mitakshara law the daughter of a coparcener is made as good a coparcener as a son. She has the same rights in the coparcenary property as she would have had if she had been a son. She has a right to agitate in respect of her share in the joint family property.
Decision of Larger Bench of the Supreme Court in re Vineeta Sharma v. Rakesh Sharma and others.
 The finding of the apex Court (Prakash and others v. Phulabati and others & Mangammal @ Thulasi and another v. T.B. Raju) that daughters are not entitled to get the benefit of equal share being co-sharers in the ancestral property, no more remains res integra in view of the Larger Bench judgment of the apex Court in the case of Vineeta Sharma v. Rakesh Sharma and others.
In the case of Vineeta Sharma, Section 6(1) of the Hindu Succession (Amendment) Act, 2005 was under consideration and a question was framed “does the Hindu Succession (Amendment) Act, 2005, which gave equal right to daughters in ancestral property, have a retrospective effect”.
The Apex Court, answered the same in affirmative, held that daughter shall remain as coparcener (one who shares equally with others in inheritance of an undivided joint family property) throughout life, regardless of the question as to whether her father was alive when the law was amended in 2005 or not
Sons and daughters of a coparcener become coparceners by virtue of birth.
Observation of the Orissa High Court
In view of the decision dt. 11.08.2020 of the Apex Court in Vineeta Sharma v. Rakesh Sharma and others., Claims Commission has committed error apparent on the face of the record by passing the order impugned denying benefit to the daughter.
The earlier judgement of the Supreme Court namely Prakash and others v. Phulabati and others & Mangammal @ Thulasi and another v. T.B. Raju has no effect in view of the subsequent decision of the Larger Bench.
The daughter has a right to get the property of her father from the date the Amendment Act came into force.
Decision
The Writ Petition was allowed and the order dated 04.01.2020 passed by Claims is not sustainable in the eye of law and was quashed. However, the matter was remitted back to the Claims Commission for re-adjudication.

“Salman Khan and Sooraj Barjatya have been discussing Prem Ki Shaadi for a while now and the film is now in the stage of hitting the floors this year. Salman and Sooraj are looking to start Prem Ki Shaadi from November/December 2023. With the film, Sooraj plans to celebrate love in the backdrop of nuclear families and is among the most special subjects that he has developed till date,” revealed a source close to the development.
Prem Ki Shaadi will be targeting a Diwali 2024 release in cinema halls across the globe and will proceed to the casting stage soon. “Sooraj Barjatya will get into the process of locking the female lead and key ensemble cast of Prem Ki Shaadi in a couple of months. While his films have always had romantic tracks leading to “shaadi”, this time around, the entire conflict revolves around the life of a married couple with strong family elements,” the source added.

He is talking to all stakeholders, apart from developing a couple of in-house films under his banner, Salman Khan Films. He will take a call on his Eid 2024 offing hopefully by April, as the idea is to start a new film by June 2023,” the source informed.
Apart from the two aforementioned project, Salman is committed to do the biggest action film of India – Tiger v/s Pathaan – for Yash Raj Films which pits him against Shah Rukh Khan. AHMEDABAD: The Gujarat high court on Thursday punished four cops with 14 days of simple imprisonment for committing contempt of the court by flogging members of the Muslim community after tying them with a pole in full public view at Undhela village in Gujarat's Kheda district on October 4, 2022, after detaining them on charges of pelting stones on a garba event. After citing Mother Teresa's example of human rights, the bench of Justice A S Suhia and Justice Gita Gopu handed down the sentence to police inspector A V Parmar, PSI D B Kumawat, head constable K L Dabhi and constable Raju Dabhi “to protect the unflinching faith of people in the judiciary”. The court made it clear that punishing the cops is not the sole objective, but it is “to instill people’s faith in the majesty of justice” and that it is “duty-bound to punish to uphold the rule of law”. The HC, however, stayed the sentence for three months after the policemen’s request to allow them time to appeal before the apex court. The court rejected their contention that giving stick blows on the buttocks of the complainants was custodial torture. The court also rejected their request to let them off by paying a fine or keeping them on probation looking at their long unblemished service records and social conditions. Following the incident of flogging in front of a cheering crowd, the victims registered complaints with a magisterial court. Five people, including a woman, approached the HC alleging contempt of the court. Their advocate I H Syed established that the public flogging took place a day after the detention of the accused and therefore it was a case of custodial torture and hence the violation of the Supreme Court’s DK Basu’s judgment. The complaint was against 13 cops. However, Kheda’s chief judicial magistrate confirmed the identity of four cops in the videos and photographs circulated on social media. The HC framed charges against the four cops on October 4 and held them guilty and punished them with two weeks’ simple imprisonment and payment of Rs 2,000 fine. Holding the cops guilty of contempt of court, the HC said, “The Supreme Court’s directions have fallen on deaf ears and there seems to be no improvement on the state of affairs. The guidelines are blatantly violated and ignored, perhaps with the expectations of gaining the Yellow Pages fame and with self-assurance and self-security of being immune to legal consequences.” The court refused to accept an unconditional apology from the cops and said that the apology “cannot wipe out the scars from the psyche of the complainants”. The bench also observed, “The feeling of getting humiliated to the extent that it obliterates the sense of being human is legally not acceptable. The acceptance of apology will send a wrong message to society at large. And everybody who has committed such an inhuman act will cultivate a feeling of being pardoned by the court of law, and who has yet not engaged in such an act, would be encouraged to do so.” The court further said, “It is apparent that the respondents (police officials) meted out the complainants with merciless and humiliating treatment. Accepting their apology will be a travesty of justice. The inhuman acts committed are beyond the contours of forgiveness.” The HC was critical of videography “the barbarous act” by the cops and its circulation on social media. Supreme Court Denies Legalizing: Same-Sex Marriages

Introduction
Since ancient times, marriage has been regarded as a sacred thread creating a bond between two people, and this bond not only connects two souls but also two families. In the past, marriage was only possible between a man and a woman. The concept of same-sex marriage or gay marriage did not exist at that time. Those who solemnized their marriage and lived together got legal and social recognition. Both statutory and personal laws have recognized heterosexual marriage, i.e., marriage between the opposite gender. However, marriage between people of the same sex was not recognized until recent times. There are only a few countries around the world that have given legal recognition to same-sex marriages. India has not accepted or granted legal recognition to same-sex marriage. In this article, we will discuss the recent decision of the Supreme Court regarding same-sex marriages in India.
Background of the case
There was a total of 21 petitions filed by various same-sex couples, LGBTQIA+ activists, and transgender persons. These petitions took issue with the Special Marriage Act 1954, the Hindu Marriage Act 1955, and the Foreign Marriage Act 1969. These petitions were transferred to the Constitutional bench of the Supreme Court on January 6, 2023. The petitioners, who are supported by prominent lawyers such as Mukul Rohatgi, Abhishek, Manu Singhvi, Raju Ramachandran, Anand Grover, Geeta Luthra, K V Viswanathan, Saurabh Kirpal, and Menaka Guruswamy have highlighted the rights of LGBTQIA+ individuals and urged the court to recognize such a union, which would enable them to lead a life of dignity comparable to that of heterosexual couples. They also urged that same-sex marriage should be given legal recognition under the Special Marriage Act so that they can avail the other benefits. The Solicitor General of India, Tushar Mehta, representing the Union of India, argued that a total of 160 laws would be affected if marriage equality was granted and further added that it is the Parliament that can make, amend, or repeal the laws and Courts have not been conferred with such powers. Senior advocate Rakesh Dwivedi, representing Madhya Pradesh State, opposed the petition along with senior advocate Kapil Sibal and senior advocate Arvind Datar.  The high-profile case was heard by a panel of five judges of the Supreme Court of India, including Chief Justice of the Union of India DY Chandrachud, comprising Justices SK Kaul and S Ravindran Bhat. The other members of the panel were Justices Hima Kohli and P. S. Narasimha.
Other countries' views on same-sex marriage
According to the Human Rights Campaign, a US-based LGBTQ advocacy group, 32 countries have recognized gay marriage. This marriage is recognized by court rulings only in 10 countries. These countries include the US, Australia, Ireland, Switzerland, South Africa, Taiwan, Argentina, and Canada. In the year 2019, Taiwan became the first country in Asia to legalize gay marriage. Most other countries around the world have already passed laws to allow same-sex couples to get married.
Judgement of the Supreme Court
On Tuesday, i.e., October 17, 2023, the constitutional bench of the Supreme Court pronounced four judgements that were written by CJI DY Chandrachud, Justice SK Kaul, Justice Ravindra Bhat, and Justice PS Narasimha, respectively. CJI DY Chandrachud and Justice SK Kaul agreed, while Justice Ravindra Bhat, Justice Hima Kohli, and Justice PS Narasimha agreed on the same opinion.
Judgement of CJI DY Chandrachud
The Chief Justice of India (CJI) ruled that the Court of Justice is not able to invalidate the Special Marriage Act (SMA) as the Parliament and State Legislature have the exclusive power to do so, leaving the decision-making to them. The Court further asserted that any invalidity of the SMA would result in the loss of the advantages of progressive legislation. Furthermore, he said that the guidelines of the Central Adoption Resource Authority (CARA), a government agency under the Ministry of Women and Child Development, discriminate against atypical, unmarried couples adopting a child, thus violating Article 15 of the Constitution, and held that unmarried couples, including queer couples, can jointly adopt a child. He was in favour of the recommendation made by the Union government to constitute a committee to determine the rights and entitlements of queer couples.
Judgement of Justice SK Kaul
Judge Kaul concurred with the view of the Chief Justice of India (CJI) that civil unions for same-sex couples should be recognised by law and that this is an important step towards achieving marriage equality.
Judgement of Justice Ravindra Bhat
He disagreed with the judgement of CJI DY Chandrachud and said that civil unions can only be granted via enacted laws. However, he also favoured the recommendation made by the Union Government. He further added that the present case is very different from previous cases in the way that previous cases were related to the protection of citizens’ rights from violence or harm caused to them by the state. He submitted that the right to marry is not a fundamental right. Justice Bhat stated that the Court does not have the power to constitute a legal framework in this regard, as there are several grounds that need to be taken into consideration, and it is only the legislature that can do so.
Judgement of Justice PS Narasimha
Consenting with Justice Ravindra Bhat, Justice PS Narasimha said that the right to marry is a statutory right and not a constitutional right. He further agreed with Justice Ravindra Bhat with respect to the CARA regulations and said that unmarried couples, including queer couples, do not have the right to adopt, and these regulations could not be declared unconstitutional. With respect to schemes of gratuity, pensions, insurance, etc. that are not applicable to queer couples, legislative policies in that respect should be taken into consideration.
Conclusion
The Supreme Court refused to give constitutional validity to same-sex marriages by a 3:2 majority and also held civil unions unconstitutional. The Supreme Court accepted the recommendation of the Union Government, as stated by the Solicitor General of India, to constitute a high-powered committee to examine the rights, entitlements, and other concerns related to same-sex couples but refused to validate the adoption by unmarried couples and queer couples.

The VEGF Molecular Signalling Pathway Mechanism Explained

Vascular endothelial growth factor-A (VEGF-A) is essential for endothelial cell functions associated with angiogenesis (1). The signalling pathway begins with the binding of VEGF Receptors (VEGFR) to the VEGF cytokine to form a homodimer, a process known as Dimerization (2). The binding of a VEGF molecule to two VEGFR molecules induces the transphosphorylation of the intracellular domains of the receptors, leading to signal transduction (2, 3). In this section, we will be investigating the most prominent ligand-receptor complex in the VEGF System: VEGF-A/VEGFR2. VEGFR2, the major signal transducer for angiogenesis, is involved in the phospholipase C-γ-protein kinase C-mitogen-activated protein kinase (PLC-γ-PKC-MAPK) pathway, which is the pathway of interest that will be explained in this section (4). In this system, the VEGF-A molecule binds to and dimerizes VEGFR-1 and VEGFR-2, and signal transduction networks initiated by the VEGF-A/VEGFR2 complex promote angiogenesis, vascular permeability, as well as endothelial cell survival, migration, and proliferation (1,3,5). The dimerization of VEGFR-1 and VEGFR-2 as well as the transphosphorylation between the receptors’ intracellular kinase domains is followed by the activation of the VEGF Receptor Tyrosine Kinase (RTK) which induces the phosphorylation of an effector known as phospholipase C — gamma (PLC-γ) (5,6). After that, PLC-γ initiates a downstream intracellular signalling cascade that is facilitated by the sequential phosphorylation of a series of proteins called second messengers (6). The intracellular signal transduction process is regulated by several kinases of the MAPK pathway which phosphorylate and activate the downstream second messenger proteins, following the order: Ras-Raf-MEK-ERK (7,8). The Ras/Raf/MAPK (MEK)/ERK pathway is the most important signalling cascade among all MAPK signal transduction pathways and plays a paramount role in the survival and development of malignant tumour cells (7). In the last step of the PLC-γ-PKC-MAPK pathway, activated ERK 1/2 phosphorylates another kinase called RSK and both molecules travel to the nucleus of the vascular endothelial cell to activate multiple transcription factors which leads to effector protein synthesis, thus promoting cell proliferation and survival, and ultimately resulting in angiogenesis (9). Therefore, it can be observed through the PLC-γ-PKC-MAPK pathway that the hyperactivation of the expression of ERK 1/2 plays a crucial role in the development and progression of cancer through the promotion of rapid — and most of all aberrant — tumour neovascularization (10).

“The Deceptive Knot: When Wedding Bells Turn to Echoes”

Before Supreme Court of India
Order
Apex Court allowed the appeal on 02.02.2024 and set aside the order of the High Court to the extent it has refrained from quashing the proceedings under Section 417 IPC against the present appellant.
Apex Court held that High Court’s reasoning for upholding the proceedings under Section 417against the present appellant is patently incorrect.
According to the High Court as the father of the informant was induced by the appellant to book a marriage hall therefore, there is prima facie material which makes out a case under Section 417 IPC.
Background
The appellant had challenged the order passed by the High Court of Karnataka on 12.07.2021 by which his 482 petition was only partly allowed.
High Court has quashed the proceedings regarding offences under Sections 406/420/417 IPC with regard to the co-accused. With regard to the present appellant section406/420IPC was quashed but the criminal proceedings U/s 417 IPC was not quashed.
Aggrieved appellant filed Criminal Appeal before the Apex Court.
Facts
Informant Ms. Sushmita (Respondent no.2 in this Appeal) had lodged her FIR at Malamaruti Police Station, Karnataka under Sections 406/420/417 read with Section 34 IPC against present appellant, mother, brothers & sisters.
The FIR, primarily related to offence of cheating and criminal breach of trust.
It was stated in the FIR that the informant is M. Tech. graduate and was working as a lecturer.
Her elders were searching a suitable bridegroom for her which they found in the present appellant.
The appellant and the informant were thereafter talking to each other on phone and her father had also given Rs.75,000/- in advance for the marriage hall, but this marriage never took place as she learnt from a newspaper report that the appellant has in fact married someone else!
Observation of the High court
406 IPC – Criminal Breach of Trust
To constitute an offence punishable under Section 406 of IPC, there must be criminal breach of trust as defined under Section 405 of IPC.
To constitute criminal breach of trust, there must be entrustment of the property or domain over the property or there must be dishonest misappropriation of such property.
Fact of the Case
A sum of Rs.15,000/- was paid to accused No.1 for purchase of clothes and spent Rs.75,000/- for booking the marriage hall, the ingredients of Section 405 of IPC is not attracted.
It cannot be said that there was entrustment of property and· there is dishonest, misappropriation of the same. Therefore, the offence under Section 406 of IPC is not made out.
420 IPC – Cheating and Dishonestly inducing Delivery of Property
To constitute the offence punishable under Section 420 of IPC, there must be cheating dishonestly by inducing the person to deliver any property or to make alter or destroy the whole or any part of valuable security etc.
Fact of the Case
On perusal of the first information in detail, it is revealed that even these requirements to constitute the offence punishable under Section 420 of IPC is not made out.
417 IPC – Punishment for cheating
Facts of case
Accused No. l (Present appellant) was having intention to deceive the informant, received the money for purchase of clothes and also got booked the marriage hall.
Prima facie it constitutes the offence under Section 415 of IPC punishable under Section 417 of IPC.
I do not find any reason to reject this contention ignoring the specific averments made in the first information.
Observation of the Supreme Court
Prerequisites to constitute the offence of cheating
. By no stretch of imagination, this is even reflected from the complaint made by the informant.
There can be multiple reasons for initiating a marriage proposal and then the proposal not reaching the desired end.
It may in a given case involve cheating; it is possible theoretically yet in order to prove an offence of cheating in such cases prosecution must have reliable and trustworthy evidence in order to first prosecute such a case.
There is no such evidence before the prosecution and therefore no offence under Section 417 is also made out.
Where a person fraudulently or dishonestly deceives another in inducing that person to deliver any property to any person etc.
If somebody is deceived to do an act which causes damage or harm to that person “in body, mind, or reputation or property is said to have cheated.

S.S. Rajamouli film 'RRR' is Glorious Indian Action Spectacle and Dance Party

If you haven’t had a chance to catch up with the action spectacular “RRR” (Rise, Roar, Revolt”) from Indian director S.S. Rajamouli yet, you are late to the party my friend. Even busy actor Jessica Chastain carved out  three hours plus from her schedule to experience what all the fuss is about and then tweeted: “Watching this film was such a party.” “RRR” features superstars Ram Charan and N.T. Rama Rao Jr. as friends and rivals in 1920’s India who clash but reunite in a struggle against the British colonialists. It’s a sort of bromance with lots of spectacular battle scenes and close calls with leopards, tigers, and wolves. There's a fabulous dance sequence to the “Naatu Naatu” song, where our heroes wipe the floor with racist English toffs who challenge them and win over the adoration of the ladies who join them in their exuberant moves. "RRR" is over the top for sure and best to just surrender to the energy of the film.  Last week at a screening for Guild members, the crowd laughed, cheered, and stomped. The movie inspires that reaction, especially during the “Naatu Naatu” dance sequence. The New York Film critics gave Rajamouli the best director prize last week and composer M.M. Keeravani just received a Golden Globe for the infectious “Naatu Naatu” song, which is also Oscar shortlisted. The film is a fantasy but loosely inspired by real-life revolutionaries, Alluri Sitarama Raju and Komaram Bheem, who battled the British colonialists but never met. Here are some takeaways from the post-screening Q&A I attended:   Where Rajamouli got the idea for the story, which is co-written by his father, veteran writer, V Vijayendra Prasad: “ I always like the idea of bringing two heroes together. Even when I was a kid, when I read two completely different stories, I would like to bring characters from the stories in my head and create my own scenes between them. Sometimes I'm a part of those scenes too. That's how I thought as a kid. And when I was reading the history of Komaram Bheem and Alluri Sitarama Raju, the revolutionaries from my part of the country, there were very interesting coincidences. They were on around the same time, at the turn of the 20th century. And when they were in their early twenties, they left their respective homes. And we don't know what happened to them. No one knows what happened to them. And they came back after three, or four years and once they came back, they started fighting against the oppressors in the same way as in the film. I imagined… If I can take that period of time, those two, three years, and I can be a completely fictional story. So except for the fact that I named them Komaram Bheem and Alluri Sitarama Raju, everything else is fictional.” On the visual effects: “I have to see visual effects as a tool. Nothing more than that… Don’t treat visual effects like the star or something special.” About working with these particular stars: “They are good friends and they are friends outside their personal rivalry… Actually, the rivalry (is) between the fans of those two (actors)… when I started writing the characters with these guys in mind, they fit in so perfectly…For Charan, the way I look at him, when I look at him, his eyes seem to be as if they're holding something very painful. And when I look at Tarak (N.T. Rama Rao Jr.) his eyes seem so innocent. There's a lot of strength in the eyes… That's the kind of feeling that I get when I look at those actors.” On the shooting schedule: “We shot it for 320 days. I mean, I'm not proud that I shot it for (so long)… I think my producers definitely are not proud that… I would like to do it much faster, but we don't have second unit directors and third unit directors in India. So pretty much every sequence, every scene, almost every shot, I had to direct. So because that's such a big film with such big episodes, I had to shoot one episode, take a break, prepare for the next episode, and shoot it so it is more linear.” Shooting the Naatu Naatu dance sequence:  “Both of them are exceptionally good dancers and we had a great song to showcase their dancing skills. And we had … a beautiful scene that leads up to the dance… Everything is properly put in. But still, I would give most of the credit of the success of that song for the dance choreographer, Prem Rakshith. He's my choreographer. He spent almost two months composing for that number. And just for the two, three signature steps or the hook line steps, he composed more than 100 variations. And you wouldn't believe me. He had four sets of assistants, two assistants each and he was composing the steps for 15, 20 steps, 15, 20 variations. And the assistants were having cramps in their legs and pain in the knees. He would take out one couple and bring in another couple and start composing… The third couple or fourth couple had to go to the hospital because (of injuries).  So he was relentless in getting what he wanted and once the steps were composed, Tarak and Charan, like I said, they're great dancers. They didn't need too much time to practice the steps. They got it quite fast, but they also had to practice a lot because I wanted them to do the steps in exact sync.” On the musical number at the end of the movie, which is a sort of roll call of politicians and freedom fighters:  “There are two, three reasons for that. One is, India had a long freedom struggle against the British (colonialist) for 90 years and almost 100 years before that…so many leaders laid down their lives fighting for the freedom of our country. As a kid, I read many of the stories, heard many of the stories, and some of the stories are so heart touching and I developed the kind of hero worship towards them. Even though my film is not about freedom struggle, (primarily) … it’s about friendship, I thought at the end, it would be a nice way of paying tribute to freedom fighters. But I didn't want to do that in a very sad way or something. I wanted it to be a celebratory kind of number… So all those things put together, I thought by going out of the theater, people should go out to the exuberant feeling, a high feeling.” After the Q&A I caught up with Rajamouli at the reception where he was surrounded by fans and well-wishers.
